Nintendo has filed a lawsuit against a pirate ring run by Gary Bowser, a leader of Team Xecuter who has been distributing Switch hacking devices.

The ever-litigious Nintendo has filed a lawsuit against what it describes as an “international pirate ring” run by Gary Bowser. This continues Nintendo’s crusade against game piracy, which has been ongoing for several years.
In a previous lawsuit against a Switch hacking provider in November 2020, Nintendo described game piracy as a “serious, worsening international problem.” Due to this, Nintendo has filed many lawsuits against those who have been pirating Nintendo Switch systems. In September 2020, Nintendo won a $2 million lawsuit against retailer Uberchips for selling products that allowed pirated games to be downloaded on Switch consoles. In 2018, Nintendo won $12 million in a lawsuit against a website that offered emulated games.
According to Polygon, Nintendo filed a lawsuit against Gary Bowser, who is a leader of the hacking group Team Xecuter, on Friday. The lawsuit states that Bowser has been hacking Nintendo devices since 2013 with the Nintendo 3DS, and has continued to do so with more than 79 million Nintendo Switch and Switch Lites. Gary Bowser has been arrested in the past for charges of fraud along with another member of Team Xecuter, Max Louarn.
There has been an ongoing debate over the ethics of emulation for some time. The legality of emulating games is something that Nintendo has the right to sue over, but many have argued that emulation helps preserve games that Nintendo hasn’t ported as of yet. As the industry continues to move forward with more powerful systems, game preservation has become a topic of concern, especially following a recent scare wherein several DSiware games were pulled from the eShop, only to be put back up shortly afterward.
With that said, that’s not what appears to be happening in this case, as Switch games are still currently being produced. But there will eventually come a time when Switch games won’t be produced anymore, whether on the next console or the one after that. Will Switch games be ported over to next gen systems? The Wii and Wii U virtual console services had games from a variety of consoles, such as the GBA and Wii, but numerous Gamecube games still have yet to be ported aside from the recent rerelease of Super Mario Sunshine in Super Mario 3D All-Stars. It’s hard to say what the future holds for Nintendo’s vast catalog of games, or for Bowser himself.
